Requirements for EB-5 Investors
Investors must invest in a new commercial enterprise in order to qualify for the EB-5 visa. A commercial enterprise is defined as a profit-based entity that is formed to facilitate the conduct of ongoing legal business. This could take form as a business trust, corporation, sole proprietorship, joint venture, partnership, holding company, or other publicly or privately owned entity.
In order to qualify for an EB-5 visa, you must:
- Invest the required amount of capital in a new commercial enterprise
- Invest in an enterprise that employs at least 10 U.S. full-time employees
- Invest a minimum of $1 million U.S. dollars without borrowing (if you are developing a new enterprise in a rural area or an area with high unemployment, you will be required to invest a minimum of $500,000)
Investors may face additional requirements and exceptions depending on whether their new enterprise is created within a regional center, outside of a regional center, or is a troubled business.
